1 EXAMPLE SEPARATION AGREEMENT
THIS DEED OF SEPARATION is made the day of

BET WEE N [name] of [address] (hereinafter called ‘the husband’) of the one part and also [name] of [address] (hereinafter called ‘the wife’) of the other part.
WHEREAS differences have arisen between the husband and the wife as a result of which they have agreed to live separate and apart from each other from the day of
AND WHEREAS the husband and the wife have agreed that the provision referred to hereafter is accepted by them in full and final settlement of all claims of a financial nature by either party against the other.
NOW THIS DEED WITNESSETH AND IT IS HEREBY MUTUALLY AGREED as follows:
1. That the husband and the wife shall hereafter be entitled to live separate and apart from one another as if they were unmarried.
2. That neither the husband nor the wife shall molest, annoy or interfere with the other.
3. That the children of the family [name] (date of birth) [name] (date of birth) shall reside with the wife who shall afford the husband reasonable contact with them.
4. That the wife shall transfer to the husband within 28 days of the date of this deed all her legal estate and beneficial
interest in the freehold property at [address] subject to the mortgage secured thereon in favour of the Building
Society and the husband shall pay or cause to be paid to the wife immediately following such transfer a lump sum of £100,000.
5. That the contents of the said former matrimonial home shall be divided between the parties by agreement.
6. That as from the date of separation referred to above the husband shall pay or cause to be paid periodical payments to the wife for the benefit of each of the said children until they shall attain the age of 18 years or cease full-time secondary education, whichever shall be the later, at the rate of £100 per month payable monthly.
7. That on the 1st January of each year (‘the variation date’) the periodical payments set out in paragraph 7 above will stand varied automatically. The change in the payments shall be the change, if any, between the Retail Prices Index for 15 months before the date of the variation and the Retail Prices Index for the month three months before the variation date.
8. That as from the date of separation referred to above the husband do pay or cause to be paid to the wife periodical payments at the rate of 5p per annum during their joint lives until the wife shall remarry or until the youngest child shall reach the age of 18 years whereupon the wife’s claims for periodical payments and secured periodical payments shall stand dismissed and the wife shall not be entitled to make any further application under the Matrimonial Causes Act 1973 section 23(1)(a) or (b) in relation to the marriage
and the wife shall not be entitled to apply for an extension of the term of the said maintenance.
9. That after two years have expired from the date of the separation referred to above either party to the marriage shall be at liberty to present the petition for divorce under the provisions of section 1(2)(d) of the Matrimonial Causes Act 1973 (as amended) and that the other party shall consent to a divorce on that basis and that each party will bear their own costs of their part in the said divorce decree proceedings save that each party will bear one half of the court fees.
10. That the husband and the wife will invite the court in such proceedings to dismiss all and any claims they may have against each other for financial provision and property adjustment.
