AFFIDAVIT OF THE PETITIONER IN SUPPORT OF
HER APPLICATION FOR DEEMED SERVICE




I SUSAN HENCHARD of 25 Dorset Road, Casterbridge, Wessex, the above named petitioner, MAKE OATH and SAY as follows:-
1. I filed my divorce petition with this court on the 1st February 2009. The court issued the petition on the 2nd February 2009 and a copy of the petition was posted to the respondent by the court on the 2nd February 2009. To date, the respondent has failed to file his acknowledgement of service with the court.
2. On the 4th February I received a telephone call from the respondent. He told me that he had received the divorce papers and that he had torn them up and thrown them in the bin.
3. In the circumstances, I would submit that the respondent has been served with the divorce papers and I would therefore ask this honourable court to direct that the petition shall be deemed to have been duly served upon the respondent, pursuant to Rule 2.9(6) Family Proceedings Rules 1991.
